Terms of Service

1. Service

Tercet ("the Service") is a classification API that provides typed uncertainty output. The Service is operated by Symbolics Lab ("we", "us"). By using the Service, you agree to these terms.

2. Accounts and API Keys

You must provide a valid email address to create an API key. You are responsible for keeping your API key secure. Do not share your API key publicly or embed it in client-side code. We may revoke keys that are compromised or used in violation of these terms.

3. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to gain unauthorized access to the Service or its infrastructure
• Reverse-engineer, decompile, or extract the source code of the Service
• Resell or redistribute the Service without written permission
• Send automated requests designed to degrade the Service for other users

4. Tiers and Rate Limits

The Service offers Free, Team, Business, and Enterprise tiers. Each tier has defined limits on predictions per month and number of models. Exceeding your tier's limits will result in rate-limited responses until the next billing cycle. We reserve the right to modify tier limits with 30 days' notice.

5. Payment

Paid tiers are billed monthly through Stripe. You may cancel at any time; your access continues through the end of the billing period. Refunds are not provided for partial months. All prices are in USD.

6. Service Availability

We aim for high availability but do not guarantee uninterrupted service. The Service is provided on an "as is" basis. Planned maintenance will be communicated in advance when possible. For Business and Enterprise tiers, uptime commitments are defined in the applicable service agreement.

7. Data and Models

Training data you send to the Service is used only to build your models. We do not use your data to train our own models or share it with third parties. Models you create are scoped to your API key and can be deleted at any time. When you delete a model, its data is permanently removed from our infrastructure.

8. Limitation of Liability

The Service provides classification output with typed uncertainty. It does not constitute professional advice (medical, financial, legal, or otherwise). You are responsible for how you use the Service's output in your applications. We are not liable for decisions made based on the Service's predictions. Our total liability is limited to the amount you have paid us in the 12 months preceding any claim.

9. Intellectual Property

The Service, its algorithms, and documentation are the intellectual property of Symbolics Lab. Your use of the Service does not grant you any rights to the underlying technology. You retain ownership of your data and trained models.

10. Termination

We may suspend or terminate your access if you violate these terms. You may terminate your account at any time by contacting sales@tercet.dev. Upon termination, your API keys are revoked and your models are deleted.

11. Changes to Terms

We may update these terms. Material changes will be communicated via email to the address associated with your API key. Continued use of the Service after changes constitutes acceptance.
